1. Acceptance of Terms
By accessing and using ClarityBird, you accept and agree to be bound by the terms and provisions of this agreement. ClarityBird is a software service powered and operated by The Workout Zone ("Provider"), located at Noble Enclave Rd, Noble Enclave, Sector 22, Gurugram, Haryana 122015. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.
2. AI-Generated Content Liability
ClarityBird utilizes advanced Artificial Intelligence (LLMs) to draft and publish responses to your customer reviews. While strict safety filters are employed to prevent hallucinations and inappropriate content, you (the business owner) are solely responsible for all content published on your behalf. The Provider of ClarityBird is not liable for any PR, legal, or financial damages resulting from automated replies or insights.
3. Disclaimer of Warranties ("AS IS")
The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Provider expressly disclaims all warranties, whether express, implied, statutory or otherwise.
4. Subscription, Payments & Merchant of Record
You agree to pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. Lemon Squeezy is our Merchant of Record and trusted payment partner. Lemon Squeezy provides order support, securely processes all payments (credit/debit cards, Apple Pay, Google Pay, PayPal), and handles all relevant sales tax, VAT, and customer invoicing.
5. Digital Delivery & Instant Access
ClarityBird is a cloud-based Software as a Service (SaaS). Access to our features, AI Autopilot, and multi-location management is delivered immediately and electronically to your account upon successful payment and authentication.
6. Cancellation & Refund Policy
We want you to be completely satisfied with ClarityBird. Every new customer starts with a 7-Day Free Trial with no credit card required. You may cancel your subscription at any time directly through your account dashboard or the Lemon Squeezy customer portal. Upon cancellation, your access remains active until the end of your current prepaid billing cycle. If you experience technical issues or are dissatisfied with your subscription, you may request a refund within 14 days of purchase by contacting us at support@claritybird.com.
7. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
